Request for Access Easement

Please be advised that a regular meeting of Sarnia City Council will be held in the Council Chambers on the main floor of City Hall on:

RE:                       REQUEST FOR AN ACCESS EASEMENT

SUBJECT LAND:     Northwest corner of Modeland Road and Berger Road



Please be advised that the City of Sarnia has received an application, requesting that the City convey an easement for access over City-owned land (the Suncor Nature Way – west) to provide for driveway access from Berger Road to the subject lands owned by the applicant, which are located at the northwest corner of Modeland Road and Berger Road (see Area Map).

The subject land is vacant and has area of 6,397m2 (68,857ft2) and frontage of 94.19m (309 ft.) on Modeland Road. Vehicular access to Modeland Road is restricted by the County of Lambton to a “right-in” entrance and “right-out” exit only. The proposed easement would have width of approximately 9m (29.5 feet) and would permit the subject land to develop as a corner lot, with vehicular access from Berger Road.

The subject land is currently zoned “General Commercial 1-10 (GC1-10) Site Zone” by Zoning By-law 85 of 2002, which permits restaurant, convenience store and gas bar uses. The applicant has submitted Rezoning Application 6-2017-85 of 2002 to request a site-specific amendment to the City’s Zoning to permit a self-service carwash as an additional permitted use in the General Commercial 1-10 (GC1-10) Site Zone (See Map 2: Applicant’s Proposed Site Plan).The easement to Berger Road will facilitate vehicular access in and out of the subject lands for the commercial uses.

The easement application is scheduled to be heard by Sarnia City Council on Monday, October 2, 2017. If you wish to request a delegation before Council to speak to this application, please contact the City Clerk on or before noon, Wednesday, September 27, 2017, in order to be placed on the agenda.

A public meeting date for Rezoning Application 6-2017-85 of 2002 has not yet been scheduled. When a meeting date is scheduled, further notification of a public meeting for the rezoning application will be given, as required under the Planning Act.
